Terms & Conditions
Last updated: 4 July 2025 · Version 2025-v1
Governing law: United Republic of Tanzania · Jurisdiction: High Court of Tanzania, Mwanza
1. Introduction and Platform Role
These Terms & Conditions (“Terms”) govern your use of the LifeGranted Adventures platform, accessible at lifegranted-adventures.co.tz, operated by LifeGranted Adventures Ltd, a company registered in the United Republic of Tanzania with offices in Mwanza.
By accessing the platform, creating an account, placing a booking, or registering as an operator, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
Marketplace intermediary
LifeGranted Adventures operates exclusively as a marketplace intermediary. We connect independent, TTB-licensed tour operators with travellers seeking safari and travel experiences in Tanzania. We are not a tour operator, travel agent, or tour provider.
The tour operator listed on each tour page is solely responsible for the content, accuracy, and delivery of that experience. LifeGranted Adventures does not participate in delivering tours and accepts no liability for operator acts or omissions, except as expressly stated in these Terms.
Eligibility
You must be at least 18 years old and have the legal capacity to enter binding contracts in your jurisdiction to use this platform. By using the platform you warrant that these conditions are met.
2. Booking and Payment
Booking process
Selecting dates, completing guest details, and submitting payment initiates a booking request. A booking is confirmed only when you receive a booking confirmation email from LifeGranted Adventures containing your booking reference number. All bookings are subject to operator acceptance.
In the rare event an operator cannot fulfil a confirmed booking, the tourist is entitled to a full refund under Section 3.
Commission and fee structure
LifeGranted Adventures charges a 15% platform commission on each booking tour price, deducted before operator payout:
- 3% — contributed to the Platform Guarantee Fund (see Section 4)
- 12% — platform operating revenue covering technology, marketing, and support
The tour operator receives 85% of the tour price, paid automatically via Flutterwave after the departure date or upon early release at the platform's discretion.
Booking fee
A booking fee is charged at checkout to cover payment processing costs. It is non-refundable in all circumstances — including cancellations, disputes, and force majeure events. The booking fee is not platform revenue; it passes through to the payment processor.
Currencies
All prices are quoted in United States Dollars (USD). Operators are responsible for any applicable local taxes on their earnings. LifeGranted Adventures is not responsible for taxes applicable in the tourist's home jurisdiction.
3. Cancellation and Refund Policy
The full cancellation policy is published at /legal/cancellation-policy and incorporated by reference into these Terms.
Tourist-initiated cancellations
- 30 or more days before travel: 100% refund of tour price
- 15 to 29 days before travel: 50% refund of tour price
- 14 days or fewer: No refund
- No-show: No refund
The booking fee is non-refundable in all cases.
Operator-initiated cancellations
If an operator cancels a confirmed booking for any reason other than force majeure, the tourist receives a 100% refund of the full tour price within 48 hours, plus a 10% credit voucher for a future booking.
Force majeure
In force majeure events (government travel restrictions, TANAPA park closures, declared natural disasters, documented security incidents), tourists will be offered:
- Option A: Full credit valid for 18 months (recommended)
- Option B: 80% cash refund within 10 business days
Refund payment
All approved refunds are paid directly by LifeGranted Adventures from the Platform Guarantee Fund within the stated timeframe. Tourists do not need to wait for operators to return funds.
4. Platform Guarantee Fund
LifeGranted Adventures maintains a Platform Guarantee Fund to ensure all approved tourist refunds are paid promptly, regardless of operator financial position.
The Fund is maintained from the 3% Guarantee Fund contribution deducted from each booking at the platform level. It does not affect operator payouts, which are calculated and disbursed at the 85% rate independently.
Where the Fund pays a refund on behalf of an operator, a recovery process may be initiated against that operator under the terms in Section 6.
5. Dispute Resolution Process
How to raise a dispute
Disputes must be submitted through the platform at /account/bookings. Quality disputes must be submitted within 7 days of the tour end date.
Process and timeline
- Tourist submits a dispute with a written statement and supporting evidence.
- The operator is notified immediately and has 72 hours to submit their response.
- LifeGranted Adventures reviews all evidence from both parties impartially.
- A decision is issued within 5 business days of the operator response deadline.
- Both parties are notified of the decision simultaneously.
- If a refund is approved, the Guarantee Fund pays the tourist within 5 business days.
Finality of decisions
Platform dispute decisions are final and binding on tourists. Chargebacks filed after a platform decision will be defended using timestamped policy acknowledgment records, booking evidence, and IP-verified acceptance data.
Operator appeal process
Operators may appeal a dispute decision within 5 days of receiving a recovery notice, via the operator portal at /portal/recovery. New evidence may be submitted. Appeal decisions are final.
6. Operator Recovery
Where LifeGranted Adventures pays a tourist refund from the Guarantee Fund on an operator's behalf, the operator is liable to repay that amount to the platform under their Operator Agreement.
How recovery works
Recovery is effected exclusively from future platform earnings. Automatic deductions are applied to the operator's payouts from subsequent bookings until the recovery amount is cleared.
The operator's existing bank accounts are never contacted, debited, or otherwise affected. No bank transfers are requested from operators. Recovery comes only from future earnings on the platform.
Security deposit
All approved operators pay a one-time refundable security deposit of USD $50 upon account activation. This deposit acts as a first-call reserve for disputes under $50, protecting regular payouts from small adjustments. The deposit is fully refunded after 12 months of active listing in good standing with no outstanding recovery notices.
Notice and appeal rights
Operators receive a formal, documented recovery notice detailing the refund evidence, applied amounts, security deposit usage, and their right to appeal within 5 days. See Section 5 for the appeal process.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the platform's maximum liability for any claim is limited to the tour price paid for that specific booking.
LifeGranted Adventures shall not be liable for: indirect, consequential, incidental, or punitive damages; losses from operator cancellation or failure to deliver; losses from force majeure events; or any amounts exceeding the tour price paid.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by Tanzanian law.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from these Terms or the use of the platform is subject to the exclusive jurisdiction of the High Court of Tanzania, Mwanza.
Operator disputes with the platform must first exhaust the platform's own dispute process before court proceedings may be initiated.
